RE: The tariff classification of artificial snow fluff from China.

Dear Mr. Stinson:

In your letter dated June 23, 2016, you requested a tariff classification ruling. A sample was provided.

The product, described as Snow Fluff 5 oz. Rite Aid Item #9027519 consists of amorphous pieces of wadding material of varying size and thickness, said to be composed of 100 percent polyester man-made fibers. This wadding material is packaged for retail in a plastic bag.

In your letter, you suggest classification as wadding in the piece under subheading 5601.22.0010, Harmonized Tariff Schedules of the United States (HTSUS). However, since this wadding is not in the form of sheets, but rather is an assortment of clumps of wadding in various sizes and shapes, this would not be considered to be “in the piece.”

The applicable subheading for Snow Fluff 5 oz. Rite Aid Item #9027519 will be 5601.22.0090 HTSUS, which provides for Wadding of textile materials and articles thereof…wadding; other articles of wadding: of man-made fibers, other. The duty rate will be 6.3 percent ad valorem.

This ruling is being issued under the assumption that the subject goods, in their condition as imported into the United States, conform to the facts and the description as set forth both in the ruling request and in this ruling. In the event that the facts or merchandise are modified in any way, you should bring this to the attention of Customs and you should resubmit for a new ruling in accordance with 19 CFR 177.2. You should also be aware that the material facts described in the foregoing ruling may be subject to periodic verification by Customs.

This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
